Smart thermostat classification: 8537 or 9032? CBP just questioned our ruling

We import Wi-Fi thermostats with learning algorithms. We have classified under 9032.10 (thermostats) for years, but CBP is now arguing 8537.10 as a 'control panel with multiple apparatus' because of the relay board and app control. The duty delta is 2.1 points plus 301 exposure. Has anyone defended 9032 for smart thermostats recently, and did GRI 3(b) essential character hold up?

We defended 9032 for smart AC controllers last year. The argument that held: the learning algorithm and app are means of setting the setpoint, not a separate function, the device still exists to maintain temperature automatically, which is the 9032 definition. GRI 3(b) never came into play because we argued it's not a composite-function device at all. Look up NY N305789, similar fact pattern, sustained.

It came up once in their information request; we answered with the heading note reference and it went quiet. Keep the response narrow.

EU angle for what it's worth: we hold a BTI classifying a comparable learning thermostat under 9032 10 20. Different customs territory obviously, but a reasoned BTI can be persuasive context in your CBP response.

Whatever you argue, quantify the exposure across open entries first, if 8537 sticks you're into 301 territory and a prior disclosure may be cheaper than a fight. Ugly but worth modelling both ways before you respond.
