Swiss export to Kuwait: Dual-use / licence assessment
Hi all,
I’m looking for some guidance regarding an upcoming export from Switzerland to Kuwait.
The shipment contains equipment/components currently classified under the following HS codes/origins:
85437099 – BE
8517.62.99 – TWN
85235100 – USA
8473.30.20 – USA
85258010 – CN
8471.50 – USA
I’m trying to establish whether any of the items could fall under Swiss dual-use/export-control requirements and therefore require further assessment and potentially a SECO licence.
I’m aware that the HS codes alone are not sufficient for a final dual-use classification, and that the relevant technical specifications/parameters and potential ECN need to be reviewed.
Has anyone dealt with similar equipment or these tariff headings and could point me towards the areas/ECNs that should be checked?
I’m also gathering the manufacturers’ technical datasheets and, where available, export-control classifications.
Anything else you would recommend checking specifically for an export from Switzerland to Kuwait, particularly regarding end user/end use or other export-control considerations?

Ask the Kuwaiti consignee for their commercial licence. It names the activities they are licensed for. If it reads general trading while the statement says own use in their own server room, two of your documents disagree. Ask for the installation address and who runs that site. An end user statement tells you who to chase afterwards. It does not keep the box still. Onward resale is ordinary across the Gulf. Ask before you book, not after your file says end user.
Strictly speaking the number your American suppliers hold is an ECCN, an Export Control Classification Number, and it points at what nobody has said: three of your six lines are United States origin. US goods stay subject to the Export Administration Regulations once they leave the country, so Switzerland to Kuwait is a reexport in American law. That assessment sits beside the SECO one, not inside it.
You need an ECCN per US-origin line, from the supplier or by classification request to the Bureau of Industry and Security, then the reason for control read against Kuwait on the Commerce Country Chart, plus end user and end use. Your Belgian, Taiwanese and Chinese lines can still be caught if they carry US content, under the de minimis rule. That arithmetic is a practitioner's, not mine.
You were right that the headings settle nothing. The American side wants the same datasheets.
Sorry, I sit on the other side of that request: I write these classifications for our own machines.
A usable one names the exact part and firmware version, says which control list and revision date it was checked against, gives the control number or states that none applies, shows the parameters it was judged on, and is signed and dated. Useless ones come back as a tariff code, which answers the customs question, not yours.
In my market these take weeks, not days, so ask now: an engineer has to answer, not the sales desk.
SECO does tell you to ask the manufacturer, but your file has to prove an export without a licence was correct. So we re-check the parameters ourselves and keep both papers. For a silent supplier, classify from the datasheet yourself, record what you compared, or ask SECO ESIG.
Under Swiss rules there is a defined route from heading to candidate entry: SECO publishes a dual use correlation table. It is a search aid, not a determination. 8471.50 alone fans out to entries in Categories 3, 4, 5, 7 and 9. Narrow those on the Annex 2 technical criteria: each entry names the one datasheet parameter that decides it.
The real issue here is not this shipment, it is master data. Your Chinese origin line is written under 8525.80. I checked the nomenclature this morning against the WCO tables: that subheading belongs to the edition before the current one. The edition in force since 2022 removed it and split those goods into 8525.81, 8525.82, 8525.83 and 8525.89. Confirm that yourself in the nomenclature and in Tares, where a Swiss number is the six HS digits plus two national ones.
Two consequences. First, a superseded subheading returns nothing in SECO's correlation table, and nothing looks identical to a clean result when it is really a miss. Second, the split separates high speed, radiation tolerant and night vision goods, which is very close to the question you are asking. This is not carelessness on your part: codes sit in a system for years. It is why a revalidation step at each nomenclature revision belongs in the SOP.
