Motor, wheels, carries a load: vehicle. Heading 8704 first, sporting goods second. CBSA read it that way, and so have other administrations on similar items. The story gives the importer's heading and stays silent on CBSA's; my money is on 8704.60, goods vehicles with an electric motor. Hundreds of units classified in-house, a lawyer called in more than a year after the duty landed. That is the failure, not the heading. Ask for a ruling before the first entry. The alternative cost $183K.

I have had a customer's auditor open a file on a part with a small motor in it and ask why it had not been classified as a vehicle part. Now anything with a motor gets a call to the customer's broker before the first shipment, and the answer goes in the file with a signature.
